Who Pays The Escrow Fees?

Who pays what is dictated by the traditions and practices in each area and what the parties mutually agree upon. This can vary from state to state and even county to county. Every transaction is different. Right now short-sales and REO’s dominate our market and customary practices are changing day to day. Having said that, see below for an idea of what to expect.

 

SELLER:
  • Real Estate Commission
  • Documentary Transfer Tax
  • City Transfer or Conveyance Tax (according to contract)
  • Owners Title Policy
  • Recording documents to clear anything of record against seller
  • Recording of the Grant Deed
  • Payoff of all loans in sellers name including interest and payoff fees.
  • Any judgments, tax liens, etc against seller
  • Any delinquent property taxes
  • Proration of current property taxes (unpaid property tax at time of closing)
  • Any delinquent homeowners association dues
  • Any HOA bonds and or assessments (according to contract)
  • Proration of current HOA dues (unpaid dues at the time of closing)
  • Termite Inspection (according to contract)
  • Termite Work (according to contract)
  • ½ of the Escrow Fee
  • Preparation of grant deed fee
  • Overnight or messenger fees as applicable
  • Home Warranty ( according to contract )

 

BUYER:
  • Lenders Title Insurance
  • Endorsement fees
  • Recording of the Deed of Trust
  • HOA homeowners transfer fee
  • All new loan charges
  • Inspection fees
  • ½ Escrow Fee
  • Doc prep fees – if applicable
  • Courier or messenger fees as applicable
  • Notary Fee for loan documents signing
  • Fire insurance premium for first year
  • Proration of current property taxes (unpaid property tax at time of closing)
  • Proration of current HOA dues (unpaid dues at the time of closing)
